WHAT IS SUPER EXTREME DUI IN ARIZONA?
If you are arrested in Arizona for driving with a blood alcohol concentration (BAC) of .20 or more, the state will charge you with super extreme DUI. It is known as a "super extreme" DUI due to the elevated BAC in the person's body. The super extreme DUI is also the highest BAC level of DUIs.
Consequently, super extreme DUI charges carry heavier penalties than regular DUI charges due to the higher BAC. Super extreme DUI charges are class one misdemeanors and carry heavy fines and penalties on conviction such as long jail sentences and driver's license suspension.
Driving under the influence offenses in Arizona are categorized by the BAC level or the presence of drugs in a person's body. A person's BAC is determined through the chemical testing of either breath or blood in a police DUI van or at a police substation. Super Extreme DUI charges would be brought if the person was driving or in actual physical control of a vehicle with a BAC of .20 or more within two hours of driving. A.R.S. 28-1382(A)(2).
