In Arizona it is illegal for a person who is under 21-years old to drive or be in physical control of a motor vehicle while there is any spirituous liquor in their body. The criminal code this is under is A.R.S. 4-244(34). Basically, a person under 21 can be found guilty under this statute for having any amount of alcohol in their body - even a few sips can be detected.
This differs from Arizona's "regular DUI" which requires the state to prove that you are slightly impaired or have a blood alcohol concentration (BAC) of .08% or more.
If a person is under 21 and driving while impaired to the slightest degree or their BAC is .08% or above, they can also be charged with a regular DUI. It is a good idea to enlist in the help of an experienced underage drinking attorney to mitigate the serious consequences. The state of Arizona harshly prosecutes underage DUI or "baby DUI" offenses. If convicted, one can expect to face the same penalties as a person over 21 would face. Unfortunately, the Arizona courts do not extend leniency due to your young age for DUI offenses and in some respects the penalties on conviction are more harsh for persons under 21.
For example, the mandatory 2-year driver's license suspension for a first offense is a very difficult consequence for young people to deal with.
